It is also advisable to consult a lawyer for Traffic Law in the case of offences due to speeding in road traffic. Only the lawyer will be able to inspect the files and check the correctness of the measurement process. If private companies are commissioned with the speed measurements, as is customary in many federal states, the measurement result is not to be used for criminal purposes, as the state is not entitled to transfer sovereign tasks to a private company. Nevertheless, the municipalities have commissioned private companies to carry out speed measurements for many years.
If a fine is imposed with points in the traffic offenders’ register, it must also be examined whether it is not possible to reach an agreement with the court in such a way that the accusation of wrongdoing in road traffic is reduced and only a fine remains as a penalty, but the setting of penalty points is waived. A full acquittal is rarely achieved, but if the defence concentrates on a minor misconduct, the chance for a reduction of the fine and a remission of the points is often the better strategy.
